If I were Levy I would have made a verey generous offer (rumoured to be £3m or £4m) for Archway to sell me the land so as to avoid the legal costs, my/Spurs employees time, costs of delay etc

As it is, we've now been delayed by possibly a year plus we will need to pay both our legal costs plus Harringay's (we indemnified them).

So if the independent market price is £1m for the site, I might still go to them and offer £1.75m for them to sell and vacate quickly - but making it clear that its being done as a sign of goodwill - provided they end this now.

Alternatively given that their antics have probably cost us a few million plus the costs of delay, I might just ***** it we're only going to pay the market costs (£1m) plus reasonable costs of moiving £100k). But better to pay a small premium of say £500k on top

You're forgetting the 2 years we waited for the CPO.

Almost smacks of the Archway Steel Lawyer seeing this as a potential Erin Brokovic moment casting themselves as David to the Golliath of The Secretary of State, Haringey Council and us...if that is the case and ego has clouded the advice hey have given Archway Steel that that is a sad thing...looking at the arguments they have put forward I cant really reach any other conclusion than their guy was trying to make a name for himself

They probably got away without paying defending council's costs but if they press on and appeal again after having been told not to they will definitely be hit with costs.
Do you think the council will sell tickets when the bulldozers go in, 2 hours before a home game before the end of the season would be the perfect time.

I'd put money on another appeal. I can see no other outcome, sadly.
I would 'now' it will be 'in for penny in for a pound'.

I expect them to apply for another appeal but based on what Justice Dove said in his ruling about their case being on semantics rather than substance I doubt the Court of Appeal will allow it.

As others have said, it sounds like it would be very unwise for them to lodge another appeal but I suspect they are now so deep in that they are foolishly trying to dig their way out of the deepening hole they've made for themselves. Its a case of desperation now as much as greed and anything else that was previously motivating them. Fuck 'em. I've zero sympathy with them, especially as they have argued against paying the Council's costs - why the fuck should this come out of the purse of the council for one of the most impoverished areas in the UK? They are exploiting the system and playing the victim when they are motivated entirely by self-interest in their fight against a scheme designed to improve the surrounding area and benefit 00s if not 000s.

What's to say it would've been accepted? For all we know Levy may as well have done precisely that.

We will not deal. Tottenham Way will need to move a lot of residents if it is to be built. Harringay (and Spurs) will not want to go through this again. So the line will be drawn. Appeal as much as you want, we will see you in court and it will cost you.

There's got to be a point when a sane person would say, enough is enough, we have it a good go but aren't going to win.

Although I suspect now the chip on their shoulder, the debts built up and the hate for spurs has got so big that they are incapable of calling it a day.

Posted on COYS, basically this is what happens next:

I want to provide some clarity around Archway's right to appeal, next steps, and timing. I do this stuff day in, day out.

Archway has 21 days to appeal Mr Justice Dove's judgement. Since he has refused them permission to appeal, they have to make an application for permission to appeal directly to the Court of Appeal. No doubt they will do this on day 21.

They lodge their application by way of an Appellant's Notice. This gets placed before a single Lord Justice of Appeal for determination. I suspect that the application will be determined around 6-8 weeks after it is lodged. During this time, Spurs need not do anything but await the outcome of the appeal.

If permission is granted, then the appeal goes ahead, and we can expect about another year's worth of litigation. If permission is refused (which I suspect will be the case), then Archway will have the right to an oral hearing to make its application for permission to appeal. I estimate that will take about another 2-3 months to be heard and determined. If Archway is refused permission there, then it is game over.

In the circumstances of this case as I understand them, Archway will be unable to appeal to the Supreme Court unless they first get permission to appeal to the Court of Appeal and then lose the appeal. Even then, appealing to the Supreme Court is extremely difficult, as a special type of permission is required. Further, on my understanding, I would say that bringing the case to the ECJ is pretty much out of the question.

So,in summary, they have three weeks to apply for permission to appeal. If they do, then that application will be determined in around 6-8 weeks. If they are refused then they will ask for an oral hearing which will be heard and determined in about another 2-3 months. If they are refused there, game over.
