Was this ever resolved?

Palacios picked up a 2 match ban on his last game for Wigan. Spurs are claiming that our game against united in the cup counted as one of these games, but Palacios was cup-tied so couldn't play anyway. He then played against Bolton.

Does a banning still count even if you are ineligible to play ?

If we fucked up - what is the likely fallout?

It was sorted, The club confirmed with FA that the United cup game was part of his suspension. Altough it seems odd to me, those are the rules.
