Arsenal and Manchester United face the daunting prospect of having to negotiate with Tottenham Hotspur chairman Daniel Levy if they want to appoint Mauricio Pochettino this season.

If Levy has any say on where he goes right now, we absolutely must not allow him to go to any rival club. Regardless of how much it would cost us.

You have to respect Levy! It s just like the time we got money from a transfer which was between two other clubs, where the player had never ever played for us!

Went from somewhere like Pompey to Stoke and for some reason, due to a previous failed deal, we made something like £5m off it?

£1m - we'd already paid an instalment on his transfer, so they had to compensate us

Just been a discussion on Talksport with the Evening Standard (I think) Correspondent who said that Poch was not actually sacked, but is on Garden leave where Levy is still paying his wages. Hence it makes sense that anyone that wants his services will have to negotiate with Levy. And people question his custodianship of this club!!

He's no man's fool, that much is certain. Just make sure Poch's next job is abroad somewhere, not here in England.

yeah it will be jarring seeing him manage another English team and watching the fanfare around his arrival.

if he is on gardening leave then the terms of his contract still hold and in theory it will cost a club about £30M to buy him out. Sure Levy is indicating this fee is now up for negotiation, but clubs wouldn't bite in the summer and they wont fancy dealing with Levy now either.

Gardening leave normally only lasts up to 6 months though, unless there is a clause in the contract specifying otherwise but that could be challenged as unreasonable.
Fancy being made to sit at home for 4 years being paid £3m+ pa. I'd be furious.

How the hell can this be possible, the contract with Spurs and Poch has been terminated, no way would any club have to negotiate with Levy. The compensation Poch is due is the only thing that could be forfeit if he signs for another club.

Speaking as an employment lawyer, he's 99% likely not on garden leave. That would mean that technically he had been given notice of dismissal by the club, and was not being required to work his notice period.

This isn't the case here. Managers are employed on fixed-term contracts for a specified period, e.g. four years. They don't normally include notice periods. Unless there are provisions in the contract for early termination, then if the manager is dismissed early they will be entitled to the salary etc they would have earned had they remained in post until the end of the fixed term.

Poch's contract almost certainly won't have included a provision allowing the club to terminate his employment early because we had a bad start this season.

When managers are sacked, they often agree an exit package with the club. Sometimes this package includes restrictive covenants preventing the manager from working for a rival club for a specified period.

[Managers' original contracts of employment can have restrictive covenants, but if the employment is terminated in breach of contract, which most managers' dismissals are, then those covenants fall away.]

Levy and he will have agreed an exit package, which will no doubt include new restrictive covenants. If Poch wants to take a new job that isn't allowed by those covenants, then he would need to negotiate with Levy to be released from them. In practice, the new employer club would do the negotiation with Levy and agree consideration (payment) for release from the restrictions.
